DMCA Policy

Seychelles is committed to respecting the intellectual property rights of others and expects its users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for copyright owners to report alleged copyright infringement and for users to file counter-notifications when they believe content has been removed by mistake.

While the DMCA is a United States law, we apply its principles to address copyright infringement claims originating from or affecting our services globally, including within Seychelles, to ensure fair and consistent treatment for all parties involved in intellectual property disputes.

Filing a Copyright Infringement Notice

If you are a copyright owner or an agent authorized to act on behalf of a copyright owner and believe that any content hosted on our services infringes upon your copyrights, you may submit a written notice of copyright infringement. Your notice must include substantially all of the following information:

  1. Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Provide a description of the material that you claim is infringing and its location on our services (e.g., a specific URL where the material can be found).
  3. Contact information of the complaining party: Your full legal name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification, you have the option to file a counter-notification. A counter-notification must be a written communication and include substantially all of the following information:

  • Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Subscriber's contact information: Your name, address, and telephone number.
  • Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Seychelles may be found, and that you will accept service of process from the person who provided the original copyright infringement notification or an agent of such person.
  • Subscriber's physical or electronic signature: Your physical or electronic signature.
